I think I have a warrant out for domestic violence, what happens next?

Domestic violence laws in Colorado are some of the toughest and you need to
get a lawyer with experience in handling these cases to assist you immediately. To start,
domestic violence is not a crime in Colorado. Rather “domestic violence” acts as a tag
or a sentence enhancer when someone is accused of committing a crime against
person when the two people have been in an intimate relationship.

The consequences for an alleged act of domestic violence are harsh. If police
make contact with two individuals on scene of a supposed act of domestic violence they
must make an arrest. This leads to numerous people being arrested before a thorough
investigation has even taken place. If police do not make contact on scene they will still
issue a warrant with a no-bond hold . If you are arrested because of an accusation
related to domestic violence or there is a warrant with a domestic violence allegation,
you will have to spend at least a night in jail before being seen by a judge.

There will also be numerous other consequences for a mere allegation of an act
of domestic violence. You will be required to relinquish any firearms in your possession
for the duration of the case. If you are convicted of an act of domestic violence, you may
be prohibited from ever possessing a firearm in the future.

You may be required to leave your own residence, even if your partner does not
pay rent. You may be ordered to have no contact with the other person involved, even if
you two share children, finances, and day to day responsibilities.

It is critical that you get an attorney on your case as soon as possible to help you
address all of the consequences of a domestic violence allegation. I always tell my
clients that these cases are some of the most frustrating because police arrest first and
ask questions later. I have helped hundreds of individuals facing allegations of domestic
violence to avoid the harshest penalties and get their life back on track either by beating
the allegations at trial or convincing the district attorney that the case is weak and the
charges won’t hold up.
